Terms and Conditions
1. Engagement and Services
Sam Baker ("Skipper") provides professional maritime services including but not limited to vessel delivery, private charters, relief crew services, and marine expeditions throughout New Zealand and the Pacific Islands.
2. Booking and Confirmation
All bookings are subject to availability and confirmation by the Skipper. A booking is considered confirmed once written acknowledgment is provided by Sam Baker via email or text message.
3. Commitment and Exclusivity
Once a start date is agreed upon, the Skipper's commitment to the job begins on that date. During the agreed period, the Skipper is exclusive to the contracted vessel and client.
4. Vessel Readiness
The vessel must be fully prepared, provisioned, and ready for departure on the agreed start date. If the vessel is not ready, a weekly standby charge will apply until departure.
5. Weather and Delays
Weather delays that occur after the vessel is deemed ready for departure do not incur additional charges. The Skipper will make all reasonable efforts to proceed safely when conditions permit.
6. Travel and Accommodation
All travel costs including flights, transfers, and accommodation required to reach the vessel or return from the destination are to be reimbursed by the client. These arrangements should be confirmed prior to engagement.
7. Operating Costs
The vessel owner/charterer is responsible for all operating costs including but not limited to fuel, food, port fees, marina charges, and safety equipment.
8. Insurance and Liability
The vessel must carry appropriate insurance coverage. The Skipper maintains professional indemnity insurance. Clients are advised to ensure their vessel insurance covers professional crew.
9. Safety and Compliance
All operations will be conducted in accordance with Maritime New Zealand (MNZ) regulations and international maritime law. The Skipper reserves the right to refuse unsafe operations or conditions.
10. Payment Terms
Payment terms are as agreed in writing for each engagement. Standard payment is required within 7 days of invoice unless otherwise agreed. Late payments may incur additional charges.
11. Cancellation Policy
Cancellations must be provided in writing. Cancellation fees may apply depending on the notice period and costs already incurred.
12. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to weather, mechanical failure, or government restrictions.
13. Dispute Resolution
Any disputes arising from these terms shall be resolved through good faith negotiation. If resolution cannot be achieved, disputes will be subject to New Zealand law and jurisdiction.
14. Modification of Terms
These terms may be modified only by written agreement between both parties. Any specific terms agreed for individual engagements take precedence over these general terms.
